Terms of Service
These Terms of Service (the "Terms") form a binding legal agreement between you ("you", "your", or the "User") and SALK AI PRIVATE LIMITED, a private limited company incorporated under the Companies Act, 2013 in India ("SALK AI", "we", "us", or "our"), governing your access to and use of the AIReel website at aireel.co and the related applications, APIs, and services (collectively, the "Service").
By creating an account, clicking "I agree", paying for a subscription, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy, Acceptable Use Policy, Refund & Cancellation Policy, and Service Delivery Policy. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872 (or the equivalent law in your jurisdiction) to use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. The Service
AIReel is an AI-assisted short-form video generation platform that enables Users to: (a) configure niches, voices, languages, music and caption styles; (b) generate scripts, voice-overs and video reels using third-party AI models; and (c) optionally schedule and publish the generated content to connected social media accounts including TikTok, Instagram, YouTube and Facebook through integrated providers.
Features, models, formats and platform integrations may be added, modified or discontinued from time to time. We will use commercially reasonable efforts to notify you of material changes.
3. Accounts
- You must register an account via our authentication provider (Clerk) to access most features.
- You are responsible for safeguarding your credentials and for all activity under your account.
- You agree to provide accurate, current and complete information and to keep it updated.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or to other users.
4. Subscriptions, pricing and billing
The Service is offered on paid subscription plans, with current pricing published on the Pricing page. Plans may be billed annually in Indian Rupees (INR) via Razorpay for Indian customers, and in United States Dollars (USD) for international customers. All prices are inclusive of applicable taxes unless stated otherwise; you remain responsible for any taxes, duties or withholdings imposed by your local jurisdiction.
By subscribing, you authorise us and our payment processors to charge the applicable fees to your selected payment method. Failure to pay may result in suspension or termination of your access. Refunds, where available, are governed by our Refund & Cancellation Policy.
5. Free trial credits
We may offer a limited number of free generations on signup. Free credits are non-transferable, have no cash value, and may be withdrawn or limited at our discretion, including in cases of suspected abuse.
6. Your content and licence to us
"User Content" means any text, images, audio, video, voice samples, brand assets, prompts, social account credentials and other materials that you submit to or generate through the Service. As between you and SALK AI, you retain all ownership of your User Content and of the videos that AIReel generates on your behalf, subject to the rights you grant below and to the rights of third-party model providers in the underlying models.
You grant SALK AI a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, process, transcode, display and publish your User Content solely to the extent necessary to: (a) operate, provide and improve the Service; (b) generate the outputs you request; (c) deliver and post content to social platforms you have connected; and (d) comply with law.
You represent and warrant that you own or have the necessary rights to all User Content and that the User Content (and our authorised use of it) does not infringe any third-party rights or violate any law.
7. AI-generated outputs
AIReel uses third-party AI models (including, without limitation, models provided by Anthropic, voice and video model providers, and publishing partners such as Zernio) to produce outputs. You acknowledge that:
- AI outputs may be inaccurate, incomplete, biased or otherwise objectionable, and may not be unique to you;
- You are solely responsible for reviewing outputs before publication and for compliance with applicable laws, platform policies, and third-party rights;
- You must not represent AI outputs as human-created where doing so is prohibited by applicable law or platform rules.
8. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. We may remove content, revoke access or report activity to authorities for any breach.
9. Third-party services
The Service integrates third-party providers including, without limitation, Clerk (authentication), Razorpay (payments), Anthropic (AI models), Zernio (multi-platform publishing), and the social platforms you choose to connect. Your use of those services is also governed by their respective terms and privacy policies. We are not responsible for the acts, omissions, availability or content of third parties.
10. Intellectual property in the Service
The Service, including all software, designs, trademarks, logos and documentation, is owned by SALK AI or its licensors and is protected by Indian and international intellectual property laws. Except for the limited licence granted in Section 11, no rights are granted to you.
11. Licence to use the Service
Subject to your compliance with these Terms and timely payment of applicable fees, SALK AI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your internal business or personal creative use.
12. Restrictions
- You must not reverse engineer, decompile or attempt to derive source code from the Service;
- You must not resell, sublicense or provide the Service to third parties as a service of your own;
- You must not use the Service to develop a competing product or to benchmark for that purpose;
- You must not abuse, overload or interfere with the Service, including by automated scraping outside of documented APIs.
13. Suspension and termination
We may suspend or terminate your access, with or without notice, if you breach these Terms, fail to pay fees, or use the Service in a manner that creates legal, security, financial or reputational risk to SALK AI or others. You may stop using the Service at any time by deleting your account; deletion does not entitle you to a refund except as set out in our Refund & Cancellation Policy.
14. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, SALK AI disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. We do not warrant that the Service or AI outputs will meet your requirements or be error-free.
15. Limitation of liability
To the maximum extent permitted by law, in no event shall SALK AI, its directors, officers, employees, affiliates or licensors be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities, arising from or related to the Service. Our aggregate liability for any claim under or in connection with these Terms shall not exceed the amount actually paid by you to SALK AI for the Service in the three (3) months immediately preceding the event giving rise to the claim.
16. Indemnity
You agree to indemnify, defend and hold harmless SALK AI and its personnel from and against all claims, damages, liabilities and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of the Service in breach of these Terms or applicable law; or (c) your violation of any third-party right, including any platform policy.
17. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to the arbitration provision below, the courts at Bengaluru, Karnataka, India shall have exclusive jurisdiction over any disputes.
Any dispute, controversy or claim arising out of or in connection with these Terms shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Bengaluru, the language shall be English, and the tribunal shall consist of a sole arbitrator mutually appointed by the parties.
18. Changes to the Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where the change is material, provide additional notice (such as by email or in-app banner). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
19. Miscellaneous
- Entire agreement. These Terms, together with the referenced policies, are the entire agreement between the parties regarding the Service.
- Severability. If any provision is held invalid, the remainder shall continue in full force.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition or sale of assets.
- Notices. Notices to us must be sent to legal@aireel.co.
